Granny Flats: Some General Considerations to Keep in Mind
FIRST PHASE: Essential components of the planning process
To meet the following requirements in order to construct a granny flat:
Be established in conjunction with another dwelling (the principal dwelling). This means that you cannot build a granny flat on a vacant block because it must be established in conjunction with another dwelling. It is imperative that you construct your granny flat before beginning work on your primary residence if you intend to use it as a temporary residence during the demolition and reconstruction of your primary residence.
Be located on the same parcel of land as the primary residence; granny flats cannot be built on the same property as townhouses, strata developments, or community title developments.
Consist of one primary dwelling and one secondary dwelling; however, subdividing the property is not allowed.
Participate in the development in the following zones:
- Zone R1 General Residential
- Low Population Density Residential Zone R2
- Residential Area with a Medium Population Density Zone R3
- Zone R4 is designated as a high-density residential area.
- Zone R5 Large Lot Residential (* may require development approval)
Note that compliance with the aforementioned four key planning requirements does not guarantee approval of a granny flat on a property; however, if your property meets the aforementioned four key requirements, you move on to the next stage of the process.
STEP 2 – Specific site requirements
The next part of this process involves the particular characteristics of your block. There are various prerequisites to meet, and they vary according to the dimensions of your block.
Minimum block size
In accordance with the current regulations, you will not be permitted to construct a granny flat on your property if the total area of your land is less than 450 square metres (also written as 450 sq m).
The minimum amount of frontage on the street
In addition to having a land area larger than 450 square metres, your property must also have a street frontage that is at least 12 metres wide.
According to the current regulations, you will not be permitted to construct a granny flat on your property if the frontage of your land is less than 12 metres wide at any point.
When the size of the block increases, the requirements for the minimum number of street frontages also increase.
The minimum width of the street frontage increases to 15 metres if the land area of the property is between 900 and 1500 square metres.
If the property is larger than 1500 square metres, the minimum width of the street frontage must be increased to 18 metres.
A granny flat cannot be larger than sixty square metres in size.
Note that the 60-square-meter allowance represents an approximation of the granny flat's external dimension. Because there will be walls on the inside and the outside of the granny flat, the space inside will be smaller. The interior space of your granny flat will be proportionally reduced if it has thicker walls, such as brickwork.
The granny flats that are currently offered by Ascension Living have external dimensions of either 10 metres by 6 metres or 12 metres by 5 metres.
Note that the 60-square-meter allowance does not take into account any garages, verandas, patios, or other outbuildings that may be approved for construction in conjunction with your granny flat. This indicates that if your covered patio is 24 square metres in size, your total built area may be up to 84 square metres in size.
It is not necessary for there to be off-street car parking for the granny flat.
Principal Private Open Space
The granny flat is required to have an outdoor entertainment area (also known as a patio), and this area must be at least 24 square metres in size, have a width of at least 4 metres, and be directly accessible from the granny flat's living room.
Take note that in addition to your maximum building footprint of 60 m2, you are permitted to add an external porch, deck, carport, or garage to your granny flat.
What does it mean for my floor area ratio if I add a granny flat?
It is essential to calculate the total floor space of your property while taking into account the addition of the granny flat. When calculating floor area, add the square metres of your existing home (such as both levels for a two-storey house) as well as any garages, carports, patios, or awnings together with the square metres of the proposed granny flat. This will give you the total floor area (which will be 60sqm).
The maximum allowable floor space varies according to the dimensions of the block. The maximum allowable floor space (including the new granny flat) for a property with a land area between 450 and 600 square metres is 330 square metres. Accordingly, if the total floor area of the property before the construction of the new granny flat is greater than 270 square metres, then you will not be permitted to construct a granny flat on the property in accordance with the current requirements (as your new granny flat will take up 60sqm).

The Procedures Involved in the Approval of Granny Flats
The approval process and construction of granny flats are both quick and simple. Your new granny flat can be built in 10–12 weeks, after which your plans can be drafted in 2 weeks, approved in 10 days, and constructed.
In order to address the lack of affordable housing in the area, the New South Wales government has recently enacted new legislation. The official title for this document is "The State Environmental Planning Policy (SEPP) – Affordable Housing." You will not be required to go through the Council DA process in order to get your plans approved if your property and plans meet the criteria for what is required. Your planning approval can be expedited and granted within ten days by a private certifier if it is a complying development. This process is called "fast-tracking." The Steps Involved in the Approval Process for Granny Flats
